Juror Research & Case Analytics

We know from 39 years of conducting research for legal matters that our work doesn’t end at the discovery deadline. We are pioneers of conducting fact-based juror research and revealing crucial pieces of information that counsel and consultants rely upon to identify favorable jurors, strike the unfavorable ones, and challenge jurors for cause.

Jury selection is one of the most important stages of a trial, and the need for diligence during that time could not be greater. Our experience with trial work has proven that the logistics of selection are never simple. Numerous factors impact the process –from venue to judge and case type to timing. Add the task of communicating with everyone who needs to give input on selection – counsel, co-counsel, local counsel, in-house counsel, consultants, co-defendants – and the process becomes downright cumbersome. All of these complexities steal valuable time that could be better spent preparing.

In an effort to regain this time, we developed JurorSMARTS™ (Solution to Manage, Analyze, Rate, and Track Selection). It is the perfect combination of technology and experience that improves communication and collaboration during the selection process and throughout the trial. However, we don’t stop at selection. We also provide seated juror research, monitoring and a variety of case analytics that will help you make more informed decisions as litigation progresses.

Voir Dire Selection & JurorSMARTS™

We provide attorneys and jury consultants with fact-based information critical to identifying favorable jurors, striking unfavorable jurors, and challenging jurors for cause.

  • Large and highly-experienced research team with access to an extensive array of exclusive databases and online sources
  • Ability to meet time sensitive deadlines
  • Customizable scope and report formats
  • Monitoring of social networking information
  • Strict protocols to maintain discretion and avoid juror contact
  • Use of JurorSMARTS™ – our advanced web-based jury selection tool that allows clients to organize and securely access juror profile information

What good is having key information if you can’t effectively share it with your team? Another basic premise of JurorSMARTS™ is that all trial team members can view, share, and comment on information.  Questionnaires, the results of fact-based research, and input from local counsel are all shared on one secure platform in real time.

JurorSMARTS™ has two key features that help counsel and consultants plan for the actual jury selection. One is the Rating feature that allows multiple users to enter and weigh objective and subjective scores. Another is the Trend Line Simulation feature whereby users can mock-strike jurors to see any shifts in the favorability of the remaining panel or pool. This Trend Line Simulation helps counsel and consultants test and plan with information about the specific pool of jurors that will hear their case.

When the big day comes, JurorSMARTS™ is the mechanism by which you can efficiently track excusals for hardships and cause, and the movement of jurors from pool to panel, and panel to box. The Trend Line Graph no longer displays just the results of simulation, but the actual changes in favorability as jurors are excused, selected, and stricken, and also provides a clear picture of who’s coming up next. This long-view allows counsel and consultants to more effectively execute strategic plans and respond to the unexpected.

Seated Juror Research & Monitoring

Jury-related research does not stop once the jury is seated. Many times in-depth research is needed to reveal background and bias information that could provide valuable insight into how a juror might impact your defense strategy. Another key feature of the JurorSMARTS™ process and system is the Monitoring Mode.  Through this mode, juror internet activity is monitored for inappropriate posts or communications regarding the trial.  Likewise, comments by the general public are also monitored, and this “social listening” helps counsel and consultants monitor the pulse of opinion.

Case Analytics (Jurors, Verdicts, Venues)

Our proprietary case analytics scoring model helps our clients make more informed litigation decisions by harnessing the power of predictive analytics. We combine actual jury pool and verdict data (not census data) to assess which jurors, verdicts and venues are most successful for the defense. Our model also aids in identifying trends. Whether you are assessing the claims of each case, the traits of a typical MDL plaintiff, the traits of the jurors being struck again and again by opposing counsel, or the impact of a juror’s background on the verdict, we can help you understand how all of the individual pieces can potentially effect case outcomes.
